Background
The principal object of the Kenya Roads (Amendment) Bill, 2023 is to amend the Kenya Roads Act (No. 2 of 2007) to ensure the equitable distribution of road resources across the country. Currently, while the burden of taxation is shared equally across Kenya, the distribution of tarmacked roads is not. This Bill seeks to address this imbalance by aligning road resource allocations with the constitutional principle of public finance, which dictates that expenditure should promote equitable development.
Key Amendments
- Section 7 of the Principal Act: Amends subsection (2) by deleting paragraph (i) and replacing it to include planning the equitable development, rehabilitation, and maintenance of rural roads in each constituency as a function of the Rural Roads Authority.
- Section 31 of the Principal Act: Amends paragraph (c) to state that monies allocated to the Rural Roads Authority and the Urban Roads Authority by the Minister for Finance shall be used specifically for the development of roads in each constituency.
- Section 34 of the Principal Act: Amends subsection (2) to mandate that the five-year road investment programme prepared by the Minister in charge of roads must outline development and maintenance priorities in each county.
