Background
In January 2009, the Parliamentary Service Commission appointed the Akiwumi Tribunal to review the terms and conditions of service for Members and employees of Parliament. On November 12, 2009, the Tribunal recommended that approximately 500 former Members of Parliament receive a living pension equivalent to USD 1,000 each, effective 1st July, 2010. Following this, the Parliamentary Service Commission adopted the report in June 2010 and resolved to set the minimum monthly pension for these former members at KSh 100,000.
Key Amendments
The Bill proposes the following amendment to the Parliamentary Pensions Act, Cap. 196:
- Section 8 Amendment: Inserts a new subsection (3) which directs that, notwithstanding subsection (2), any former Member of Parliament who served between 1st July, 1984 and 1st January, 2001, and whose monthly pension is less than KSh 100,000, shall have their monthly pension set to KSh 100,000.
Financial Implications
In accordance with Article 114 of the Constitution, this is a money Bill. The enactment of this Bill will require the additional expenditure of public funds to finance the increased pension payments for the designated former Members of Parliament.
