Section 53 explicitly exempts the sponsors and members of the newly established County Governments Retirement Scheme from making Tier II contributions to the National Social Security Fund (NSSF).

2

Mandatory Contribution Rates Established

Establishes clear rules for funding the defined contribution scheme under Section 24:

  • Member Contributions: Eligible employees must contribute at least 7.5% of their monthly pensionable emoluments.
  • Sponsor Contributions: Employers (sponsors) must contribute up to double the employee's rate or 20% of the employee's pensionable emoluments, whichever is lower.
  • Voluntary Top-ups: Members are permitted to make additional voluntary contributions to the scheme.
3

Up to KSh 5 Million Fines for Non-Remittance

Enforces strict timelines and high financial penalties for unpaid contributions:

  • Payment Deadline: Deductions must be remitted by the 10th day of the following calendar month (Section 24(5)).
  • Late Interest: Contributions delayed past 15 days attract a 5% monthly interest charge (Section 24(7)).
  • Criminal Offence: Willful failure to remit contributions or misappropriation of assets carries a fine of up to KSh 5 million, imprisonment for up to 5 years, or both (Section 49).
4

Repeal of Cap. 272 and Asset Transfer

Repeals the existing Local Authorities Provident Fund Act (Cap. 272) under Section 54, and manages the transition under Section 55:

  • Asset Vesting: All funds, assets, property, and records of the former Local Authorities Provident Fund automatically vest in the new Scheme.
  • Deemed Membership: All eligible employees and existing members under the repealed Act are transitioned into the new scheme.
  • Liabilities: All existing rights, liabilities, and ongoing legal proceedings of the old fund continue under the new entity.
