Commissioners Designated as Part-Time
Amends Section 4 of Cap. 412D to require that the chairperson and members appointed under Article 230(2)(a), (b), and (c) of the Constitution serve on a part-time basis rather than a full-time basis. Their terms remain non-renewable and set at six years.
Reduction of Commission Operational Costs
Aims to lower public spending by eliminating full-time operational costs for the Commission. The sponsor outlines that the Commission's core duties—such as reviewing State officer remuneration and advising county governments—are periodic and do not require full-time execution.

Background
The Salaries and Remuneration Commission (SRC) is established under Article 230 of the Constitution of Kenya to review and set the compensation of State officers and advise public entities on wage bills. Currently, Section 4 of the Salaries and Remuneration Commission Act (Cap. 412D) mandates that the chairperson and specific commissioners serve on a full-time basis. Since the functions of the Commission are periodic rather than continuous, this Bill seeks to convert these roles into part-time positions to reduce public operational costs.
Key Amendments
Amendment of Section 4 of Cap. 412D
The Bill deletes the existing subsection (3) of Section 4 of the Salaries and Remuneration Commission Act and replaces it with two new subsections:
- New Subsection (3): Mandates that the chairperson and members appointed under Article 230(2)(a), (b), and (c) of the Constitution shall serve on a part-time basis for a non-renewable term of six years.
- New Subsection (4): Explicitly retains the part-time service requirement for members appointed under Article 230(2)(d) and (e) of the Constitution.
New Obligations
Transition to Part-Time Status
The chairperson and specified members of the Commission are obligated to transition from full-time service to a part-time operational framework, executing their mandates during periodic sessions rather than as continuous full-time roles.
