Background
The Labour Relations Act regulates the establishment, registration, and operations of trade unions, employers' organisations, and federations in Kenya. Currently, the Act does not prescribe a maximum number of terms that officials of these organisations can serve. The Labour Relations (Amendment) Bill, 2024 seeks to insert governance structures by introducing term boundaries and term limits to promote periodic rotation of leadership within these entities.
Key Amendments
The Bill amends the Labour Relations Act by inserting a new section 34A immediately after section 34:
- Term Limits (Section 34A(2)): Prohibits any person from holding office as an official of a trade union, employers' organisation, or federation for more than two terms.
- Term Timeline Definition (Section 34A(1)): Clarifies that an official's term begins on the date they are elected and concludes on the date when the next official is elected in accordance with section 34.
Transitional Provisions
- Clause 3: Deems all existing officials of trade unions, employers' organisations, or federations to be duly elected under the amended Act for the remainder of their current active terms, preventing immediate displacement of sitting leadership upon enactment.
