Background
The Kenya Roads Board Act, 1999 (No. 7 of 1999) establishes Constituency Roads Committees in every constituency to advise the Kenya Rural Roads Authority on the formulation of annual roads programmes. This amendment seeks to foster better alignment and coordination between constituency-level funding structures and national road authorities.
Key Amendments
- Section 17(2)(a) Amendment: Updates references to constituency committee representation, replacing the generic "Constituency Development Fund Committee" with the formally designated "National Government Constituency Development Fund Committee".
- New Section 17(4A) Insertion: Mandates that the Constituency Roads Committee must provide a formal mechanism for consultation between the National Government Constituency Development Fund Committee and the Kenya Roads Board on all matters relating to constituency roads under the Act.
New Obligations
- Consultative Mandate: Constituency Roads Committees are now legally required to establish and maintain active channels of consultation with National Government Constituency Development Fund Committees in their respective regions to streamline local road infrastructure planning.
