Background
Under Section 5(2A) of the Kenya Revenue Authority Act (Cap. 469), the Kenya Revenue Authority has the authority to establish an institution to provide capacity building and training for its staff, the general public, and other jurisdictions. However, the existing law does not outline the operational scope of this training school, known as the Kenya School of Revenue Administration (KESRA). This Bill introduces a clear legal framework to define its educational and training mandates.
Key Amendments
Amendment of Section 5 of Cap. 469
The Bill inserts a new subsection (2B) immediately after subsection (2A) to explicitly define the functions of the training institution. These functions include:
- Offering revenue administration programs and other deemed fit programs, either directly or in collaboration with other institutions of higher learning.
- Developing curriculum materials.
- Conducting student assessments or examinations and awarding certificates.
New Obligations
To operate under the new legal framework, the Kenya School of Revenue Administration must:
- Establish and implement standardized curricula for its programs.
- Set up examination and assessment frameworks to evaluate student progress.
- Formalize collaborative agreements when partnering with other institutions of higher learning to deliver training programs.
