Mandatory Offices in Every Constituency
The Bill proposes to insert subsection (1A) into Section 5 of the Births and Deaths Registration Act (Cap. 149), legally requiring the Cabinet Secretary to appoint at least one registration area in each constituency.
Addressing the Deficit of 143 Centers Nationwide
Currently, there are only 143 births and deaths registration centres across Kenya. This amendment aims to make these essential registration services reasonably accessible to all parts of the country in line with Article 6(3) of the Constitution.
New Public Funding Allocations
The enactment of this Bill is projected to require additional public funds, which will be allocated in the budget estimates to set up and maintain the new registration areas.

Background
Currently, Kenya has only one hundred and forty-three (143) births and deaths registration centres nationwide. Consequently, many citizens lack reasonable access to vital registration services. This shortfall conflicts with Article 6(3) of the Constitution of Kenya, which requires that state organs ensure services are reasonably accessible in all parts of the country. The Births and Deaths Registration (Amendment) Bill, 2024 seeks to resolve this challenge by decentralizing registration facilities to the constituency level.
