Immediate Representation of Persons with Disabilities
Amends Article 54(2) of the Constitution by deleting the words "ensure the progressive implementation of" and replacing them with "implement". Eighteen Dedicated Seats in the National Assembly
Amends Article 97(1) to remove "persons with disabilities" from the general special interest group nomination pool (which consists of 12 members) and instead establishes a dedicated category of 18 members nominated by parliamentary political parties to represent persons with disabilities.
Three Nominated Seats in the Senate
Amends Article 98(1)(d) of the Constitution to replace the existing representation of two members with three members nominated by parliamentary political parties, in proportion to their members in the Senate, to represent persons with disabilities.
Alignment of Proportional Representation and Vacancy Rules
Amends Articles 90(1) and 101(2) of the Constitution to ensure that the newly created nominated seats for persons with disabilities in the National Assembly are allocated on the basis of proportional representation via party lists, and that any subsequent vacancies are filled accordingly.

Background
This Bill, sponsored by Senator Crystal Asige, seeks to amend the Constitution of Kenya, 2010, to address the historical exclusion of persons with disabilities (PWDs) from decision-making and legislative processes. Under the current constitutional framework, representation of PWDs in the National Assembly is lumped together with youth and workers within 12 special interest seats, and the five percent representation requirement in public bodies is subject to "progressive implementation." This amendment introduces dedicated seats and immediate realization of PWD representation.
