Background
The Unclaimed Financial Assets (Amendment) Bill, 2024 seeks to amend the Unclaimed Financial Assets Act, 2011 (No. 40 of 2011). The principal objective of the Bill is to expand payment options for claimants by giving asset owners and claimants the explicit statutory power to designate alternative payees to receive payments on their behalf from the Unclaimed Financial Assets Fund. It also updates the reporting requirements for demutualization proceeds.
Key Amendments
- Designation of Alternative Payees (Sections 28 & 45): Under the current Act, payments of unclaimed assets are restricted to the validated owner or claimant. The Bill amends Section 28(5) and Section 45(1) and (2) to permit the Unclaimed Financial Assets Authority to make payments to "such other person as the claimant [or owner] may designate."
- Reporting of Demutualization Proceeds (Section 8): The Bill deletes Section 8(2) of the Principal Act and substitutes it with a provision requiring holders of unclaimed demutualization proceeds to file an initial one-time report.
New Obligations
- Reporting Mandate for Asset Holders: Holders of unclaimed demutualization assets are obligated to file a one-time report of these proceeds to the Unclaimed Financial Assets Authority.
- Strict Timeline: This report must be filed no later than six (6) months after the commencement of the Amendment Act.
Transitional Provisions
- Holders of unclaimed demutualization assets must transition to the new reporting regime and submit their initial reports within the designated six-month window from the date the Act comes into force.
