Background
Many individuals in Kenya, particularly those in the informal, non-formal, and 'Jua Kali' sectors, acquire high levels of skill, expertise, and competency through hands-on practice rather than traditional academic institutions. However, they often lack formal certificates to prove these competencies. The Industrial Training (Amendment) Bill, 2024 aims to establish a legal framework to acknowledge and certify these prior learning achievements, improving access to formal employment and further education.
Key Amendments
The Bill proposes targeted changes to the Industrial Training Act (Cap. 237):
- Section 2 (Interpretation): Inserts a definition for 'prior learning' to encompass skills and competencies gained outside traditional academic structures.
- Section 3A (Powers and functions of the Authority): Mandates the National Industrial Training Authority to establish a structure for assessing and certifying individuals with informal or experiential skills in vocational trades and crafts.
- Section 5 (Duties and functions of Board): Requires the National Industrial Training Board to establish the official systems and processes for the recognition and assessment of prior learning.
New Obligations
- National Industrial Training Authority: Obligated to create, structure, and maintain the systems required to evaluate, test, and formally certify candidates who apply for the recognition of prior learning.
- National Industrial Training Board: Mandated to maintain and review the assessment systems to ensure they properly recognize competencies gained in informal environments.
