Background
The principal object of the Kenya Roads (Amendment) (No. 2) Bill, 2025 is to amend Section 13 of the Kenya Roads Act, Cap. 408. This amendment is intended to align the legislative framework governing the roads sector with the Mwongozo Code of Governance for State Corporations. Currently, the Kenya Roads Act provides that the Directors-General of the Kenya Rural Roads Authority (KeRRA), the Kenya Urban Roads Authority (KURA), and the Kenya National Highway Authority (KeNHA) serve for a term of five years. This is contrary to the Mwongozo Code, which mandates a three-year term, renewable once, for Chief Executive Officers or equivalent positions in state corporations.
Key Amendments
- Section 13(3) Amendment: The Bill proposes to delete the word "five" from Section 13(3) of the Kenya Roads Act and substitute it with the word "three". This reduces the term of office for any newly appointed Director-General from five years to three years.
Transitional Provisions
- Unexpired Terms: Any person holding the office of Director-General immediately before the commencement of the Act shall continue to serve for the remaining unexpired period of their term.
- Reappointment Eligibility: An officer who is serving their first term at the time of commencement of the Act shall be eligible for appointment for one further term of one year.
